Terms and conditions

1. Vehicle Condition & Return

The vehicle is delivered to the Renter in good working condition, clean, properly identified, and suitable for regular use. Any existing cosmetic or mechanical damages are recorded at checkout in a written inspection checklist attached to the rental contract.

The vehicle must be returned at the end of the rental period in the same condition as noted at checkout, allowing for normal wear and tear resulting from regular use.

A cleaning fee of €10 will be applied if excessive cleaning is required. The same fee applies to the removal or damage of any identifying elements, such as stickers or branding.


2. Authorized Drivers

The vehicle may only be driven by the Renter. A second driver is permitted only if communicated in advance and expressly authorized by the Owner. In such cases, the second driver will be identified under the same conditions as the Renter and will be jointly and severally liable for all obligations under this agreement.


3. Driver Requirements

  • Minimum driver age: 18 years
  • A valid driving license, recognized under Portuguese and international law, appropriate for the rented motorcycle category, is mandatory
  • If the driver has B license (car) and at least 25 years old, they can drive a scooter up to 125cc in Portugal
  • A minimum of two (2) years of riding experience is required

If the driver has less than two years of experience, an additional fee of 20% of the daily rental rate will apply.


4. Insurance, Liability & Deposit

The rental includes mandatory Third-Party Liability Insurance (TPL) as required by Portuguese law.

No Collision Damage Waiver (CDW), theft insurance, or personal accident insurance is included. The Renter is fully responsible for any damage, loss, or theft of the vehicle, accessories, or equipment, up to the full market value of the scooter.

A security deposit of €200 is required at the start of the rental. This deposit may be used to cover damages, fuel differences, fines, administrative costs, or any other liabilities arising during the rental period.

Deposit refund:

  • If paid in cash, the deposit will be returned immediately upon vehicle inspection at return, provided everything is in order
  • If paid by credit card, the release may take up to 10 business days, depending on the card issuer

5. Proper Use & Prohibited Activities

The vehicle must be used responsibly and in accordance with traffic laws and manufacturer guidelines.

Misuse includes, but is not limited to:

  • Riding off-road or on unsuitable terrain
  • Riding under the influence of alcohol, drugs, or medication affecting driving ability
  • Allowing unauthorized drivers to operate the vehicle
  • Overloading the scooter or transporting passengers beyond legal limits
  • Participation in races, sports events, or competitions
  • Negligent or reckless driving

All costs resulting from misuse are the sole responsibility of the Renter.


6. Geographic Restrictions

The vehicle may only be used on Terceira Island. Transporting the vehicle to other islands or off Terceira by any means is strictly prohibited.


7. Helmets & Safety Equipment

One helmet is included with the rental. A second helmet is available upon request at a cost of €3 per day.

The Renter is responsible for the proper use, safekeeping, and return of all helmets and safety equipment. Loss or damage of any helmet may result in a charge of up to €200 per unit.


8. Fuel Policy

All vehicles are delivered with a full fuel tank and must be returned with a full tank.

If the vehicle is returned with missing fuel, the Owner will charge the cost of the missing fuel plus a €20 refueling service fee.


9. Breakdowns & Roadside Assistance

24-hour roadside assistance is available via a contact number provided at pickup.

If a breakdown is due to a technical or mechanical issue not caused by the Renter, no costs will be charged.

If the breakdown is caused by misuse, negligence, or rider error, the Renter will be responsible for all related costs. The final determination will be made after inspection by the designated garage or service provider.


10. Accidents, Theft & Obligations

In the event of an accident, damage, loss, or theft, the Renter agrees to:

  • Immediately notify the Owner
  • Report the incident to the police and obtain an official police report
  • Collect identification and contact details of all involved parties and witnesses
  • Not admit fault or responsibility at the scene
  • Not abandon the vehicle and take reasonable measures to protect it from further damage

A police report is mandatory in all cases of accident or theft, in line with standard international vehicle rental practices.


11. Fines & Legal Violations

All traffic violations, fines, penalties, or administrative fees incurred during the rental period are the sole responsibility of the Renter.

Upon request, the Owner may provide the authorities with the identification of the responsible driver.


12. Rental Period, Extensions & Delays

The rental period ends on the agreed date and time specified in the contract. Rentals are charged per 24-hour periods.

Any extension must be requested and confirmed by the Owner and is subject to availability.

Unjustified delays will be charged as follows:

  • Delay up to 1 hour: free
  • Delay beyond 1 hour: an additional rental day will be charged

13. Keys

Loss of keys will incur a charge of €45.

If the key is locked inside the scooter and cannot be retrieved without assistance, a €30 service fee will apply.


14. Force Majeure & Early Returns

No refunds are due for early returns, unused rental time, or non-use of the vehicle due to weather conditions, personal reasons, or force majeure events.


15. Data Protection (GDPR)

The Renter’s personal data is collected and processed solely for the purposes of executing this rental agreement, legal compliance, insurance requirements, and customer service, in accordance with the General Data Protection Regulation (GDPR). Personal data will not be shared with third parties except where legally required.


16. Governing Law & Jurisdiction

This rental agreement is governed by Portuguese law.

Any disputes arising from this agreement shall be exclusively settled in the courts of Angra do Heroísmo, expressly excluding any other jurisdiction.


These Terms & Conditions are provided in two languages. In case of discrepancy, the Portuguese version shall prevail.
